Η ανακοίνωση της Επιτροπής, η οποία ελέγχει την εφαρμογή του κοινοτικού δικαίου, τερματίζει την διένεξη των Βρυξελλών με την Βουδαπέστη για το έκτακτο αυτό τέλος που αποτελούσε μέρος του πακέτου μέτρων του Ορμπάν για την αντιμετώπιση της κρίσης.
Η εξέλιξη αυτή σημειώθηκε ενώ οι σχέσεις της Επιτροπής και της κυβέρνησης του Ορμπάν έχουν φθάσει στο ναδίρ, καθώς αξιωματούχοι της ΕΕ εμφανίζονται να διακατέχονται από απογοήτευση όσον αφορά τις τακτικές της ουγγρικής κυβέρνησης για την προώθηση αμφιλεγόμενων μεταρρυθμίσεων.
Η Επιτροπή είχε ζητήσει από την Ουγγαρία να καταργήσει το ειδικό τέλος στις τηλεπικοινωνιακές εταιρίες που θεωρούσε ότι παραβιάζει το κοινοτικό δίκαιο. Αναγκάστηκε όμως να αποσύρει την προσφυγή της αφού το Ευρωπαϊκό Δικαστήριο της ΕΕ είχε αποφανθεί υπέρ της γαλλικής κυβέρνησης σε μια παρόμοια υπόθεση.
Εάν το δικαστήριο αποφαινόταν σε βάρος της η Ουγγαρία πιθανόν θα αναγκαζόταν να επιστρέψει εκατομμύρια ευρώ σε εταιρείες τηλεπικοινωνιών.
Η απόφαση της Επιτροπής να υποχωρήσει ενδέχεται να οδηγήσει στη συνέχιση των ανορθόδοξων πολιτικών του Ορμπάν, όπως η επιβολή του υψηλότερου φόρου στις τράπεζες στην Ευρώπη και η εκ νέου κρατικοποίηση ιδιωτικών συνταξιοδοτικών ταμείων με αποθεματικά δισεκατομμυρίων ευρώ.
Η χώρα με το υψηλότερο χρέος στην κεντρική Ευρώπη μπόρεσε να αποφύγει την αθέτηση πληρωμών χάρη σε ένα δάνειο 20 δισ. ευρώ από το ΔΝΤ και την ΕΕ. Αλλά αμέσως μόλις ανέλαβε πρωθυπουργός το 2010 ο Ορμπάν είχε τερματίσει εκείνο το πρόγραμμα, επιλέγοντας να αυξήσει τη φορολογία στα έσοδα των τραπεζών και άλλων επιχειρήσεων.
Στην ουγγρική τηλεπικοινωνιακή αγορά είναι η Magyar Telekom, θυγατρική της γερμανικής Deutsche Telekom AG, αλλά και θυγατρικές της βρετανικής Vodafone και της νορβηγικής Telenor.

(Reuters) - The European Commission has dropped legal action against Hungary's special tax on the telecoms sector, one of a battery of measures that stoked annoyance in Brussels over the prime minister's unorthodox economic policies.
The announcement on Tuesday by the European Union's executive, which is in charge of policing EU law, draws a line under a dispute with Budapest over a levy that was one of Viktor Orban's 2010 package of so-called crisis taxes.
It comes at a time when relations between Budapest and Brussels have reached a low ebb, with many officials working in the bloc's administration frustrated by the tactics used by Hungary and its leader to push through contested reforms.
The European Commission had asked Hungary to abolish its special tax on telecom operators, believing it broke EU law. It was prompted to abandon this action, however, by an unfavourable ruling from the EU Court of Justice in a similar case involving France.
If a court judgment had gone against it, Hungary might have had to pay back millions of euros in telecommunications revenues.
The decision to back down will reinforce Orban's unorthodox policies that have included Europe's highest bank tax and renationalising billions of euros worth of private pension fund assets.

EC drops case against Hungary over telecoms tax...
ReplyDeleteThe European Commission dropped its pending case against Hungary with the European Court of Justice regarding the telecoms tax introduced in 2010. The EC turned to the court last October, after sending a letter of formal notice to Hungary. Had the court decided for the Commission the Hungarian state would have to repay somewhere in the neighbourhood of HUF 200 billion (EUR 714.98 million).
The decision to withdraw the case against Hungary and against Spain came after the European Court decided in favour of France in a similar case, the Commission’s spokesman’s office said in a statement. “In view of the recent Court of Justice judgement regarding telecoms charges in France, the Commission has decided on 18 July 2013 to withdraw the cases pending before the Court against Spain and Hungary on telecoms charges,” the statement said.
The Luxembourg-based court ruled that France’s sectoral tax levied on electronic telecommunications service providers was not in breach of the EU’s authorisation directive. Article 12 of the directive states that „administrative charges imposed specifically on telecom operators should only cover costs related to the management and regulation of the sector.” The court said that the charge levied in the French case was a tax not an administrative charge, so the stipulations of the directive does not apply to this case.
