Χάγη: Προκαταρκτική εξέταση για τα επεισόδια στο Mavi Marmara .... Στην επίθεση ισραηλινών κομμάντος είχαν σκοτωθεί οκτώ τούρκοι ακτιβιστές

Η εισαγγελέας του Διεθνούς Ποινικού Δικαστηρίου στη Χάγη έκανε δεκτή προσφυγή που κατατέθηκε σχετικά με την επίθεση ισραηλινών κομάντο στον στολίσκο ανθρωπιστικής βοήθειας προς τη Γάζα –επίθεση η οποία κατέληξε στο θάνατο εννέα τούρκων πολιτών – και θα αρχίσει προκαταρκτική έρευνα. 
Το αίτημα προέρχεται από τις Κομόρους νήσους, που βρίσκονται στην Αφρική, γιατί ένα από τα πλοία (μεταξύ τους ήταν και το Mavi Marmara) ήταν υπό σημαία της χώρας. Στο ΔΠΔ εκπροσωπούνται από τουρκική δικηγορική εταιρεία.

Η έναρξη προκαταρκτικής έρευνας από την εισαγγελέα δεν συνεπάγεται ότι θα αρχίσει κανονική έρευνα, περισσότερο δε ότι θα φτάσει να εκδικαστεί η υπόθεση στο ΔΠΔ.



Υπενθυμίζεται πάντως ότι το Ισραήλ δεν είναι μέλος του ΔΠΔ, όπως δεν είναι οι ΗΠΑ, η Ρωσία και η Κίνα.

Το Δικαστήριο έχει δικαιοδοσία μόνο επί των μελών του για υποθέσεις τις οποίες έχει παραπέμψει σε αυτό το Συμβούλιο Ασφαλείας του ΟΗΕ ή άλλα γεγονότα που έχουν συμβεί στην επικράτεια των μελών του.

Στην προσφυγή επισημαίνεται από τους τούρκους δικηγόρους ότι τα γεγονότα στο Mavi Marmara συνέβησαν σε έδαφος των Κομόρων, άρα το ΔΠΔ έχει δικαιοδοσία.

Στον επίθεση στο πλοίο, στις 31 Μαΐου 2010, σκοτώθηκαν οκτώ τούρκοι και ένας τουρκοαμερικανός ακτιβιστής. Πολλές δεκάδες παλαιστίνιοι και άλλοι τραυματίστηκαν ή κρατήθηκαν από τις ισραηλινές Αρχές.

Το περιστατικό προκάλεσε απότομη και ραγδαία επιδείνωση στις ως τότε θερμές σχέσεις Τουρκίας και Ισραήλ. Πρόσφατα μόνο –και με παρέμβαση του Μπαράκ Ομπάμα– επικοινώνησαν ο Ταγίπ Ερντογάν και ο Μπένιαμιν Νετανιάχου, αν και η τουρκική πλευρά δηλώνει ότι η αποκατάσταση θα είναι σταδιακή.

  1. International Criminal Court opens initial probe into Gaza flotilla raid....

    The War Crimes court prosecutor is obliged to open probe after complaint from the tiny African state of Comoros, to which the Mavi Marmara vessel Israel raided in 2010 was registered. Few preliminary examinations lead to full investigation, let alone trial.

    The International Criminal Court's prosecutor said on Tuesday she would open a preliminary examination into the events surrounding the 2010 Israel Navy raid on a Turkish-flagged aid flotilla to the Gaza Strip.

    Nine Turkish citizens died during the raid on the Mavi Marmara vessel, part of a flotilla which set out from Turkey to the Gaza. The International Criminal Court is the permanent war crimes court in The Hague, Netherlands.

    Prosecutor Fatou Bensouda said in a statement she was obliged to open a preliminary examination following a referral from the Indian Ocean island nation of Comoros, to which the Mavi Marmara was registered. Few preliminary examinations ever lead to a full investigation, let alone a trial.

    The tiny African state of Comoros, a member of the court, though Israel is not. The Mavi Marmari was registered in Comoros, an archipelago off the African coast near Madagascar with a population of around 800,000.

    As required by the court's rules when a member state complains , "My office will be conducting a preliminary examination in order to establish whether the criteria for opening an investigation are met," she said in response to the referral, which was transmitted by a Turkish law firm. Bensouda said she met Tuesday with lawyers from a Turkish law firm that is representing Comoros.

    "After careful analysis of all available information, I shall make a determination that will be made public in due course."

    Previous attempts to engage prosecutors in an investigation of Israel have stalled due to lack of jurisdiction. The ICC has jurisdiction over its members, over cases that are referred to it by the UN Security Council and over events that take place on the territory of member states.

    In a filing, lawyers from the Istanbul-based law firm Elmadag argued that events that took place on the Mavi Marmari should be considered as having occurred on the territory of Comoros.

    The court, which is not part of the United Nations, relies on assistance from member states and other governments to enforce its rulings. The United States, Russia and China are not members, but 122 other countries are.

    Sudan, despite being a member, has refused to arrest its president, Omar al-Bashir, who is wanted by the court for alleged war crimes and crimes against humanity. The court's arrest warrant against al-Bashir has been opposed by the African Union and League of Arab States, among others.

    Relations between Turkey and Israel were badly strained by the Gaza flotilla incident. The two have since taken some steps toward a rapprochement. Israel offered an apology and compensation, and the Turkish and Israeli leaders agreed to try to normalize their relationship.

    Earlier this month, a second round of reconciliation talks between Israel and Turkey took place in Jerusalem, after which Prime Minister Benjamin Netanyahu's bureau announced that a draft agreement had been formulated “but a number of clarifications are needed on a few issues."

    These issues include payment of compensation to the families of the victims of the flotilla raid.

    The negotiations for reconciliation between the two former allies began in April, exactly a month after Prime Minister Benjamin Netanyahu called his Turkish counterpart, Recep Tayyip Erdogan, and apologized for the fatal raid.

    A la demande des Comores, la CPI va chercher à déterminer si les éléments sont réunis pour ouvrir une enquête. Neuf Turcs avaient trouvé la mort lors de l'assaut israélien sur la flottille.

    Bientôt une enquête sur la flottille pour Gaza? Trois ans après le raid mené par Israël le 31 mai 2010, causant la mort de neuf Turcs, la Cour pénale internationale va ouvrir un examen préliminaire. Il permettra de "déterminer si les critères pour ouvrir une enquête sont réunis" a indiqué la procureure, Fatou Bensouda.

    C'est le gouvernement des Comores, auprès duquel était enregistré le Mavi Marmara, navire amiral de la flottille internationale d'aide humanitaire, qui a saisi la CPI. En effet, la Cour n'a pas de compétence automatique en Israël puisque Tel Aviv n'a pas ratifié le traité fondateur de la CPI. D'après la BBC, des avocats font valoir que l'événement s'est déroulé sur le territoire comorien.
    Vers un réchauffement des relations turco-israéliennes

    Les Comores ont demandé une enquête pour crimes contre l'humanité et crimes de guerre, dont meurtre, torture et actes inhumains. La flottille avait été arraisonnée dans les eaux internationales par un commando israélien alors qu'elle tentait de rallier Gaza, sous blocus israélien. Selon le texte de plainte, la flotille de huit navires transportait 700 personnes et 10 000 tonnes de vivres, médicaments, maisons préfabriquées...

    En septembre 2011, un rapport de l'ONU avait jugé "excessive" et déraisonnable cette intervention militaire, mais avait considéré légal le blocus imposé par Israël à la bande de Gaza.

    A la demande de Barack Obama, le Premier ministre israélien Benjamin Netanyahu a présenté ses excuses à la Turquie fin mars. Depuis, des responsables turcs et israéliens se sont rencontrés pour discuter de l'indemnisation des familles des victimes, première étape du réchauffement des relations entre les deux pays.

  3. No step back on legal cases against Israeli army in Mavi Marmara case: İHH head....

    The head of the Humanitarian Relief Foundation (İHH), the non-governmental organization that organized the flotilla to Gaza in 2010, has insisted that the ongoing cases against Israeli commandos will not be dropped, as negotiators are close to striking a long-awaited deal on compensation for Turkish victims.

    İHH head Bülent Yıldırım said the cases could only be dropped if approval from the families of the victims was given.

    The May 2010 Israeli attack on the Mavi Marmara while it was in international waters on its way to Gaza sent relations between Israel and Turkey to an all-time low.     A senior Israeli minister on Feb. 13 accused Turkey's prime minister of blocking a compensation deal for those killed in a 2010 raid on the Mavi Marmara by demanding Israel end the Gaza blockade.

    Israel and Turkey have been locked in 11 months of talks over compensation for nine Turkish nationals killed in a deadly Israeli raid on the Gaza-bound flotilla in May 2010, with officials on both sides recently confirming they were close to a deal. But earlier this week, Turkish Prime Minister Recep Tayyip Erdoğan said there would be no agreement without a written commitment by Israel to lift its restrictions on the Gaza Strip, which is ruled by Hamas, a Palestinian militant group.

    "I am in favour of an agreement with Turkey, but (the current impasse) is Erdoğan's fault," Strategic Affairs Minister Yuval Steinitz told public radio.   5. Lawyers overseeing the Mavi Marmara case have criticized the recent reconciliation process between Turkey and Israel....

    While commenting on a possible dismissal of the cases of the Israeli soldiers who were involved in the deadly raid in return for compensation and an apology to the relatives of victims, lawyers said: “This cannot be an issue of bargaining. Those who have killed people will be held accountable. To interfere with these cases would affect the freedom of judiciary.”

    Foreign Minister Ahmet Davutoğlu earlier this month said compensation talks between the two countries had reached “a certain level” and “problems have been substantially overcome.”

    Lawyer Uğur Yıldırım said the case could not be finalized unless the court handed down the final sentence, dismissing claims that a possible agreement between the two sides would block further lawsuits. “We don’t accept their apologies,” Yıldırım said, speaking on the behalf of the victims’ families.
