The court was ordered by the Italian Supreme Court to determine the length of the political ban in connection with the media mogul’s tax fraud conviction and four-year jail term, after prosecutors conceded mistakes in the original five-year ban.
Berlusconi, 77, is already facing the loss of his Senate seat after losing his final appeal in the tax fraud case this summer, under a 2012 law stipulating that anyone convicted to more than two years in prison is forbidden from participating in politics for six years.
If the Senate votes to remove Berlusconi, he will forfeit his parliamentary immunity from prosecution in a number of criminal cases.
He will also be forced to serve a year under house arrest, or performing some sort of community service, which is his preferred option, according to a request he submitted to the court last week.
With the loss of his Senate seat pending, the leader of Forza Italia earlier this month made a desperate bid to bring down the government by threatening to yank his five Cabinet ministers out of government.
But in a rare swipe at Berlusconi’s authority, supporters aligned themselves with the forces of “stability” instead, voting to support the government of Premier Enrico Letta.
The flamboyant Italian politician and billionaire tycoon has grabbed headlines in the past not only for his brash political and business style, but for the adventures of his private life as well.
In June, an Italian court declared Berlusconi guilty both of paying for sex with an underage prostitute - a girl of Moroccan decent nicknamed Ruby Heartstealer - and abusing his office to cover up the relationship.
Berlusconi, who went far at introducing the term “bunga bunga” into the modern vernacular, was sentenced to seven years for his indiscretion. Yet it is highly unlikely the media mogul and political powerhouse will be forced to trade in his playboy lifestyle for the rigid routine of prison life due to an Italian appeals process that promises to provide sensational fodder for Italian newspapers for many years to come.

ReplyDeleteRetour aux sources pour Silvio Berlusconi. L'ancien Premier ministre italien a relancé vendredi 25 octobre son ancien parti Forza Italia, en lieu et place du Peuple de la Liberté (PDL), son actuelle formation.
Alors que la question du soutien au gouvernement d'Enrico Letta avait manqué de faire éclater le parti il y a quelques semaines, Silvio Berlusconi a donné des gages. "Nous continuerons à soutenir le gouvernement", a-t-il déclaré. Forza Italia est le nom du parti qu'il avait fondé en 1994, lors de son entrée en politique.
Les modérés ont boycotté le vote
Selon certains analystes, cités par Reuters, cette manoeuvre est une tentative du Cavaliere de reprendre l'avantage sur les modérés de son camp. Ces derniers l'ont forcé à soutenir le gouvernement alors que le Cavaliere voulait le faire tomber pour éviter de purger sa condamnation à un an de prison ferme pour fraude fiscale.
Les cinq ministres PDL du gouvernement, dont le chef de file des modérés, Angelino Alfano, ont d'ailleurs boycotté le vote du changement de nom. Autre fait troublant, le Peuple de la Liberté n'est pas dissout, mais suspendu. Comme si Silvio Berlusconi voulait empêcher ses rivaux de claquer la porte et de reprendre le nom.

ReplyDeleteROME: An Italian Senate Committee on Tuesday postponed a decision on whether a vote to expel former Prime Minister Silvio Berlusconi from the upper house should be secret, further delaying the moment when his political fate will be sealed.
The vote in the full Senate will decide the future of the billionaire media magnate, who has dominated Italian politics for the past two decades. Another Senate committee recommended earlier this month that Berlusconi, 77, should lose his seat following a conviction for tax fraud.
A meeting to decide on the voting procedure, scheduled for Tuesday, was suspended until Wednesday to allow the Senate to vote on measures cutting public administration spending.
Berlusconi's centre-right loyalists have been fighting a running battle to delay or block a vote on his Senate expulsion, ever since the supreme court in August confirmed his fraud conviction.
They want a secret vote in the hope that some rebels from the other parties may support him in defiance of their leaders.
The Senate is dominated by Berlusconi opponents from leftist groups including the Democratic Party, which rules with the media magnate's centre right in an awkward governing coalition, and the anti-establishment 5-Star Movement. So the Senate is expected to vote to strip him of his seat.
The conviction involved a massive fraud at Berlusconi's Mediaset broadcasting empire. The supreme court sentenced him to four years in jail - commuted to one year under a previous general amnesty. He has asked to serve the sentence doing community service.
The decision over his future has been one of the most sensitive issues facing Prime Minister Enrico Letta's left-right coalition, which came close to collapsing last month when Berlusconi pulled his ministers out of the government.

Le vote du Sénat sur la déchéance de Berlusconi ne sera pas secret...
ReplyDeleteUne commission du Sénat italien a décidé mercredi que le vote sur la déchéance de Silvio Berlusconi à la suite d'une condamnation à un an de prison ne serait pas secret, provoquant la colère de ses partisans.
Partagé entre un vote secret et un vote public, les deux possibilités existant à la Chambre haute, la commission a voté à une majorité de sept membres contre six en faveur d'un vote où chaque sénateur, invité à se prononcer, exprime à voix haute sa décision en passant devant le banc de la présidence du Sénat.
Le 1er août, la Cour de cassation a confirmé la première condamnation définitive du Cavaliere : une peine de prison de quatre ans pour fraude fiscale dans l'affaire Mediaset, ramenés à un an en raison d'une amnistie. Une loi votée en 2012 pour assainir la politique italienne prévoit la déchéance des parlementaires condamnés définitivement à une peine de prison et leur expulsion pour six ans, mais cette décision doit être validée en séance plénière par la chambre d'appartenance de l'élu.
Dans le cas de Silvio Berlusconi, une conférence des chefs de groupes devrait avoir lieu en début de semaine prochaine, mardi ou mercredi, pour programmer ce vote, vraisemblablement vers la mi-novembre.
Le Peuple de la liberté (PDL), le parti du Cavaliere, poussait en faveur du vote secret dans l'espoir que des sénateurs puissent voler au secours de Silvio Berlusconi à la faveur d'un vote anonyme. Craignant ce scénario, la gauche et le mouvement Cinq étoiles de l'ex-comique Beppe Grillo militaient activement contre cette option.
Après des semaines d'empoignades politiques, la décision de la commission a provoqué une avalanche de critiques à droite.
"C'est un moment sombre pour la démocratie", a déclaré Maurizio Gasparri, vice-président (PDL) du Sénat, tandis que la sénatrice Alessandra Mussolini a estimé que ce vote "conduisait à la crise de gouvernement".

ReplyDeleteΈφεση άσκησε σήμερα ο πρώην πρωθυπουργός της Ιταλίας Σίλβιο Μπερλουσκόνι εναντίον της καταδίκης του για προαγωγή στην πορνεία και κατάχρηση εξουσίας σε μια πολύκροτη υπόθεση που έγινε γνωστή με μια φράση που είχε χρησιμοποιήσει ο ίδιος: «Μπούνγκα-Μπούνγκα».
Σε πρώτο βαθμό ο Μπερλουσκόνι, ο ηγέτης του δεξιού κόμματος Φόρτσα Ιτάλια, καταδικάστηκε σε επτά χρόνια κάθειρξη με αναστολή και του επιβλήθηκε διά βίου στέρηση του δικαιώματος του εκλέγεσθαι διότι εκρίθη ότι είχε προαγάγει στην πορνεία την –τότε ανήλικη– χορεύτρια σε νάιτ κλαμπ Καρίμα Ελ Μαχρούγκ, με το ψευδώνυμο «Ρούμπι», και κατόπιν χρησιμοποίησε την εξουσία του για να συγκαλύψει τις έρευνες των αρχών για την υπόθεση.
Η ποινή είχε επιβληθεί με αναστολή διότι εκκρεμούσε η έφεση.
Ο Μπερλουσκόνι προσέφυγε μέσω των δικηγόρων του στο εφετείο του Μιλάνου. Σύμφωνα με τους συνηγόρους υπεράσπισης του, «πρέπει να αθωωθεί διότι δεν έχει διαπράξει κανένα από τα εν λόγω αδικήματα».
Η ετυμηγορία του δικαστηρίου της ιταλικής συμπρωτεύουσας ανέφερε ότι «ο κατηγορούμενος και πρώην πρωθυπουργός συνευρέθηκε σεξουαλικά με την ανήλικη, τότε, Μαροκινή Ρούμπι Καρίμα Ελ Μαχρούγκ, προσφέροντας σε αντάλλαγμα χρηματικά ποσά που κατά κανόνα ήταν της τάξης των 3000 ευρώ για κάθε συνεύρεση και τιμαλφή».
Η δικαστική αυτή απόφαση του Ιουνίου δεν σχετίζεται με την απόφαση του Αυγούστου, όταν στον Μπερλουσκόνι είχε επιβληθεί τελεσίδικη καταδίκη για απάτη και φοροδιαφυγή.
