Parents of 2 Americans killed in Benghazi attack sue Hillary Clinton

The parents of two Americans killed in the 2012 terror attack on the United States consulate in the northern Libyan city of Benghazi have filed a wrongful death lawsuit against Democratic presidential nominee and then-secretary of state Hillary Clinton.


In the suit, filed late Monday in a Washington DC district court, Patricia Smith and Charles Woods, the parents of Sean Smith and Tyrone Woods, allege the private email server Clinton used while at the State Department was partly to blame for the attack.

"Islamic terrorists were able to obtain the whereabouts of Ambassador Christopher Stevens and thus the US State Department and covert and other government operations in Benghazi, Libya and subsequently orchestrate, plan, and execute the now infamous September 11, 2012 attack," the suit, made available to media on Tuesday, said.

Smith and Woods died along with ambassador Stevens and CIA security contractor Glen Doherty during the jihadist assault.

The suit also accuses Clinton of defamation and intentional infliction of emotional distress.

There was no immediate public response from the Clinton campaign.

The founder of Freedom Watch, lawyer Larry Klayman, alleges a link between Clinton's private e-mail account used for her communications with Stevens and a leak that allegedly led to the attack.

Three weeks ago, Smith's mother attended the Cleveland Republican Convention that proclaimed Trump's candidacy and said she considered Clinton directly responsible for her son's death.

The suit was brought with the help of the conservative organization Freedom Watch.

The suit also alleges Clinton "made false and defamatory statements negligently, recklessly, purposefully, and/or intentionally with actual malice."

FBI Director James Comey announced in July that an investigation into Clinton's email practices by his agency recommended no charges be leveled against her.

He noted, however, that Clinton and her staff had been "extremely careless" in their handling of classified information.
